Lo scandalo della legge-truffa italiana che viola il Porto Franco internazionale di Trieste e i diritti di tutti gli altri Stati

Il 23 dicembre il Parlamento italiano ha approvato la legge finanziaria o “di stabilità” 2015 dello Stato italiano, formata da un unico articolo con un caos di 735 commi, per un totale di oltre 340.000 caratteri).
On December 23rd, the Italian Parliament has passed the Financial Law, or “stability law”, of the State of Italy for year 2015, that is one only article with a mess of 735 sub-paragraphs (and over 340.000 keys).
Nonostante la complessità della legge l’anziano presidente della Repubblica dimissionario Giorgio Napolitano l’ha firmata e promulgata immediatamente, assieme al premier Renzi, al Ministro delle Finanze Padoan ed al Ministro della Giustizia Orlando, senza le verifiche di legittimità doverose.
Despite the complexity of the law, the elderly, outgoing President of the Republic of Italy, Giorgio Napolitano, along with prime minister Renzi, the Minister of Finance, Padoan, and the Minister of Justice, Orlando, immediately signed and promulgated that, without the needed verification of its the legality.
La legge porta il numero 190/2014 ed i suoi commi n. 618, 619 e 620 sono palesemente anticostituzionali perché eliminerebbero il Porto Franco Nord di Trieste (indicato falsamente come un “porto vecchio” inutilizzabile) violando il diritto internazionale, gli obblighi internazionali della Repubblica Italiana ed i diritti di tutti gli altri Stati all’uso ed alla gestione del Porto Franco internazionale di Trieste.
The Law is No. 190/2014 and its sub-paragraphs 618, 619 and 620 are clearly anti-constitutional, as these would eliminate the Northern Free Port of Trieste (falsely said to be an “old port” that cannot be used) in violation of both international law and of the international obligations of the Republic of Italy, but also in violation of the rights of all other States as for the use and management of the international Free Port of Trieste.
Fra tali Stati vi sono, in particolare: Svizzera, Austria, Ungheria, Repubblica Ceca, Slovacchia, Polonia, Stati Uniti, Regno Unito, Francia, Russia, Cina, India, Brasile, Sudafrica, Israele, l’Arabia Saudita e gli altri Paesi arabi.
Among said States there are, in particular: Switzerland, Austria, Hungary, the Czech Republic, Slovakia, Poland, the USA, the United Kingdom, France, Russia, China, India, Brazil, South Africa, Israel, Saudi Arabia and other Arabi countries.
Le tre norme per eliminare il Porto Franco Nord di Trieste sono state inserite nella legge con un’operazione a sorpresa organizzata da dirigenti locali e nazionali del Partito Democratico (PD), per mezzo del senatore Francesco Russo, che ha approfittato della votazione in blocco della legge al Senato nelle ore notturne dei giorni precedenti le feste di Natale.
The three norms to eliminate the Northern Free Port were added to the Financial Law with a sudden operation, organized by the local and national heads of the Italian Democratic Party (Partito Democratico – PD), brought forward by Senator Russo, who took advantage of the block vote held in the Senateby the night, short before Christmas holidays.
Qualche giorno prima le tre norme erano state dichiarate inammissibili perché estranee alla materia della legge finanziaria. Ed in realtà si tratta di una legge-truffa speciale inserita con l’inganno in una vasta legge generale per farla approvare inosservata e senza discussione.
Prior to the vote, a few days before, the three norms were declared inadmissible, as they had nothing to do with the matters of the Financial Law. And these are actually a special fraud-law, deceptively inserted in a wide, general law, only to have these passed in silence and to prevent any discussion on the matter.
Lo scopo di quelle che chiameremo perciò norme-truffa è attribuire alle autorità locali italiane a Trieste il potere di eliminare illecitamente l’intero settore Nord del Porto Franco internazionale per consentirvi speculazioni immobiliari ed edilizie private da 1,5 miliardi di euro, sulle quali vi sono pubblici interrogativi anticorruzione ed antimafia.
The purpose of these that, therefore, we are going to call fraud-norms is to give to local Italian authorities in Trieste the power to illegally eliminate the whole Northern sector of the international Free Port to allow illegal building and housing speculations in the area, conduced by private subjects and amounting to EUR 1,5 billions, an operation known to public for being under serious anti-mafia and anti-corruption questions.
Da alcuni mesi a Trieste i promotori della speculazione avevano aumentato le pressioni politiche e mediatiche sull’opinione pubblica e sul Governo italiano per forzare l’eliminazione del Porto Franco Nord, come se fossero pressati da speculatori delusi.
In Trieste, it’s been months since the promoters of the speculation had increased their pressure on public opinion through both politics and press, but also on the Italian Government, in order to force the elimination of the Northern Free Port, as if they were all pushed by unsatisfied speculators.
In aprile fonti di intelligence occidentale non italiane avevano segnalato minacce da ambienti di ‘ndrangheta interessati alla speculazione immobiliare. Secondo le informazioni, progettavano di sbloccare l’impasse dei politici colpendo le tre diverse linee di difesa del Porto Franco internazionale: l’attività politica e giudiziaria del Movimento Trieste Libera per conto del Free Territory of Trieste, l’attività informativa della Voce di Trieste e l’attività istituzionale della presidente dell’Autorità Portuale di Trieste, che è invece un organo dello Stato italiano.
In April, non-Italian western sources of intelligence had reported threatens coming from the environments of criminal organization ‘ndrangheta holding interests as for the illegal building speculation. According to the information provided, they wanted to unblock the impasse of politicians by attacking the three defensive lines of the international Free Port: the political and legal action conduced by the Free Trieste Movement – Movimento Trieste Libera on behalf of the Free Territory of Trieste, the campaign of information of newspaper La Voce di Trieste and the institutional actions of the President of the Port Authority of Trieste, who, on the contrary of these two, is an officer of the State of Italy.
La minaccia di ‘ndrangheta è stata bloccata nei modi opportuni, ma è stata immediatamente sostituita con le azioni sempre più aggressive organizzate da settori dei servizi italiani che abbiamo descritto nella precedente analisi, e da un’intensificazione frenetica dell’aggressività mediatica dei politici promotori della speculazione, in particolare contro la Presidente dell’Autorità Portuale per impedire che venga riconfermata alla scadenza del mandato (15 gennaio 2015, ora prorogato di 45 giorni).
The threaten of the ‘ndrangheta has been blocked by adopting the necessary measures, but it has immediately been substituted with more and more aggressive actions organized by certain sectors of Italian secret services that we described in our previous analysis, and with a frenetic increment of the aggressiveness of the politicians who promote the speculation through the media, who did especially target the President of the Port Authority to prevent her for being confirmed in charge once her mandate expires (on January 15th, 2015, extended to 45 more days).
Queste operazioni sono ora culminate con le norme-truffa fatte approvare al Parlamento italiano per tentar di sgomberare la strada da tutti e tre gli ostacoli alla speculazione illecita. Secondo le nostre informazioni la maggioranza dei ministri del Governo italiano non erano e non sono ancora (6 gennaio) al corrente di questo colpo di mano, né del suo significato e dei suoi retroscena.
By now, these operations culminated in having the fraud-norms approved by the Italian Parliament to attempt clearing the way from all three obstacles of the illegal speculation. According to our information, the majority of the Ministers of the Italian Government were and currently are (January 6th) unaware of this wave of hand, of its meaning and of its background.
Sinora i promotori della speculazione l’avevano infatti forzata soltanto con attività illegittime delle amministrazioni e delle istituzioni locali italiane a Trieste e con pesanti campagne di stampa e propaganda sul quotidiano monopolista locale “Il Piccolo” (gruppo Espresso) per influenzare il Governo attraverso le rassegne stampa dei Ministeri e dei partiti.
Because, up to this moment, the promoters of the illegal speculation had only attempted to force it by illegal actions of local administrations and institutions in Trieste, as well as conducing intense press campaigns and propagandas on the monopolistic local newspaper “Il Piccolo” (it belongs to corporate L’Espresso) in order to influence the Government through the press reviews of both Ministries and Political Parties.
Era ignara del significato delle norme-truffa sul porto di Trieste anche la quasi totalità dei membri del Parlamento italiano, dove si sono opposti all’approvazione soltanto tre deputati triestini: Massimiliano Fedriga (Lega), Aris Prodani (M5S), Sandra Savino (FI).
Even the majority of Italian Parliamentarians was unaware of the meaning of the fraud-norms concerning the port of Trieste, and it was only three Deputies from Trieste who opposed to the approbation of these: Massimiliano Fedriga (Lega Nord), Aris Prodani (M5S), Sandra Savino (Forza Italia).
La sola organizzazione politica che ha avviato una strategìa per impedire l’approvazione e la promulgazione delle norme-truffa, ed ora la loro applicazione, è il Movimento Trieste Libera.
The only political organization to propose a strategy to prevent the approval and promulgation of the fraud-norms first and, currently, to prevent their enforcement, is the Free Trieste Movement.
Inganno al Parlamento, anticostituzionalità e truffa internazionale
Deceiving the Parliament, anti-constitutionality and international fraud
Trieste Libera ha già segnalato con argomenti giuridici ed informazioni anticorruzione ed antimafia al Presidente Napolitano, ai Governi dei Paesi interessati, al Ministro italiano alle Infrastrutture ed ai Trasporti Maurizio Lupi ed all’Autorità Anticorruzione italiana che le norme contestate sono un inganno contro il Parlamento italiano, che la loro applicazione verrà bloccata perché sono anticostituzionali, e che fanno parte di un tentativo di truffa internazionale.
The Free Trieste Movement has already addressed with legal arguments as well as with anti-corruption and anti-mafia reports President Napolitano, the Governments of the concerned States, the Italian Minister of Infrastructure and Transport Mr. Maurizio Lupi as well as Italian Anti-corruption Authority (Autorità Anticorruzione) informing them that the norms under question are deceptive, at the expenses of the Italian Parliament, that their enforcement shall be prevented as these are against the Constitution, as well as the fact that these are part of an international fraud attempt.
L’inganno contro il Parlamento italiano consiste nel fatto che i presentatori delle norme-truffa hanno nascosto agli altri Parlamentari che la Repubblica italiana non ha sovranità, e quindi non ha giurisdizione, sul Porto Franco internazionale di Trieste, che è stato costituito dal Trattato di Pace di Parigi del 1947 quale ente di Stato (state corporation) del Free Territory of Trieste, Paese membro di diritto delle Nazioni Unite affidato con il Memorandum d’intesa di Londra del 1954 all’amministrazione fiduciaria speciale civile provvisoria del Governo italiano per conto del Consiglio di Sicurezza, e non allo Stato italiano.
The deception against the Italian Parliament consists in the fact that the ones bringing forward the fraud-norms have hidden to other Parliamentarians that the Republic of Italy has not sovereignty − therefore it has not jurisdiction − on the international Free Port of Trieste, established under the Treaty of Peace of Paris of 1947 as a state corporation of the Free Territory of Trieste, ex officio a Member State of the United Nations which, on behalf of the UN itself, is entrusted under a mandate of temporary civil administration − the Memorandum of Understanding of London of 1954 − to the Italian Government, not to the State of Italy.
Il Trattato di Pace ed il Memorandum di Londra sono tuttora in vigore, come conferma anche il Trattato italo-jugoslavo del 1975, che ha dichiarato inefficace il Memorandum soltanto nelle relazioni tra i due Stati, i quali non ne erano parti contraenti, e la Costituzione della Repubblica italiana vincola l’ordinamento giuridico dello Stato e l’attività legislativa al rispetto delle norme e degli obblighi del diritto internazionale.
Both the Treaty of Peace and the Memorandum of Understanding of London are in force, as confirmed also by the Italian-Yugoslav treaty of 1975, as that has declared ineffective the Memorandum only in the bilateral relations between the two States, which were not Contracting Parties of that, while the Constitution of the Republic of Italy bounds the legal system of the State and its legislative actions to respect the norms and obligations established under international law.
L’unica modifica del Trattato di Pace è avvenuta secondo l’art. 30, n. 3 della Convenzione di Vienna sul diritto dei Trattati, nel 1991-92 con il riconoscimento internazionale della sovranità slovena e croata su una zona accessoria (ex “zona B”) del Free Territory of Trieste. Il Free Territory of Trieste consiste perciò dal 1991-92 della sua sola parte principale (ex “zona A”) rimasta sotto amministrazione fiduciaria speciale del Governo italiano e formata dalla città di Trieste con il Porto Franco internazionale e cinque Comuni minori.
The only modification of the Treaty of Peace took place in years 1991 – 1992, under Article 30, sub-paragraph 3 of the Convention of Vienna on the Law of Treaties, with the international recognition of the sovereignty of Slovenia and Croatia over an accessory zone of Free Territory of Trieste (former “zone B”). Consequently, since 1991-1992, the Free Territory of Trieste only consists in its main part (former “zone A”) as that has since long remained entrusted to the Italian Government and itconsists in the city of Trieste with the international Free Port and five smaller Municipalities.
Il Porto Franco internazionale di Trieste non appartiene quindi al demanio dello Stato italiano ma a quello del Free Territory of Trieste, ed il Parlamento italiano non ne può disporre.
Therefore, the international Free Port of Trieste is not part of the State Properties of the State of Italy, as it belongs to the Free Territory of Trieste, and the Italian Parliament cannot take decisions about it.
L’anticostituzionalità è evidente, poiché le tre norme-truffa vìolano radicalmente la Costituzione italiana, art. 10, primo comma «L’ordinamento giuridico italiano si conforma alle norme del diritto internazionale generalmente riconosciute.» e 117, primo comma: «La potestà legislativa è esercitata dallo Stato e dalle Regioni nel rispetto della Costituzione nonché dei vincoli derivanti dall’ordinamento comunitario e dagli obblighi internazionali.»
The anti-constitutionality is clear, as the three fraud-norms do radically violate both Article 10, sub-paragraph 1 of the Italian Constitution since «The Italian legal system conforms to the generally recognized principles of international law.» and Article 117, sub-paragraph 1: «Legislative powers shall be vested in the State and the Regions in compliance with the Constitution and with the constraints deriving from EU legislation and international obligations.»
La truffa internazionale consiste nel fatto che le norme anticostituzionali ottenute dal senatore Russo e dal PD con l’inganno servono in realtà ad un gruppo trasversale identificato di politici italiani e di loro complici e speculatori per simulare legittima l’eliminazione a loro vantaggio del Porto Franco Nord, che è uno strumento di lavoro essenziale del Free Territory of Trieste, della sua popolazione e di tutta la Comunità internazionale.
The international fraud consists in the fact that the anti-constitutional norms deceptively archived by Senator Russo and by the PD, in reality, are only useful for a transversal, identified group of Italian politicians and their accomplices, and to the promoters of the illegal speculations, in order to simulate the legitimacy of the elimination − for their own advantage − of the Northern Free Port, which is instead an essential source of jobs for the Free Territory of Trieste, for its population and for the whole International Community.

Le campagne di propaganda e disinformazione per mezzo del quotidiano “Il Piccolo” hanno invece la funzione di ingannare l’opinione pubblica locale, influenzare gli altri media e, come detto, i Ministeri ed i partiti italiani, e di screditare gli oppositori.
At the same time, the campaigns of propaganda and disinformation through newspaper “Il Piccolo” are used to deceive local public opinion, to influence other media and − as already mentioned − to deceive Italian Ministers and Political Parties, but also to discredit the opponents.
La disinformazione principale consiste nel far credere falsamente che la struttura del Porto Franco Nord sia ormai inutile perché tecnicamente superata e non riattivabile. In realtà il Porto Franco Nord è stato lasciato in graduale abbandono proprio per consentire la speculazione illegale, ma può essere riattivato rapidamente e con costi normali, come dimostra anche un progetto presentato nel 2009 dagli operatori portuali triestini per la concessione dell’area.
The mains disinformation consists in the false claim that the structure of the Northern Free Port is by now useless because it is outdated and it cannot be activated again. The reality is that the Northern Free Port has slowly been abandoned only to allow the illegal speculation, yet, it can be reactivated quickly and with average investments, as proofed with a 2009 project of Triestine port management bodies willing to receive a concession on the whole area.
I promotori della speculazione illegale hanno usato le campagne di propaganda sul quotidiano anche per influenzare illecitamente le gare pubbliche di concessione nel Porto Franco, per allontanare investitori, per ottenere la presidenza dell’Autorità Portuale, per preparare l’inganno al Parlamento italiano e per convincere il Presidente della Repubblica a promulgare senza verifiche le norme che consentirebbero la truffa.
The promoters of the illegal speculation did also use the propaganda campaigns on the newspaper to influence public calls for tenders for the concessions of the Free Port, to alienate investors, to seize the Presidency of the Port Authority, to prepare the deception at the damage of the Italian Parliament and to convince the President of the Republic to promulgate, without further verifications, the norms that make this fraud possible.

Un sistema istituzionale non è corrotto soltanto quando accetta denaro per violare le leggi, ma anche quando opera per altri motivi contro gli interessi della comunità. La presenza operativa di un sistema di corruzione locale e nazionale dietro le operazioni illegali contro il Porto Franco internazionale di Trieste è perciò confermata anche dal fatto che sono rimaste senza esiti tutte le denunce giornalistiche e penali perfettamente documentate che sono state presentate e pubblicate in argomento dal 2010 ad oggi.
An institutional system is not corrupted only when it accepts bribes in order to violate certain laws, but also whenever it acts, even for other reasons, against the interests of the community. Therefore, the active presence of a local − and national − system of corruption hiding behind the illegal operations against the international Free Port of Trieste is also confirmed by the fact that all the denounces − both reports by the press and actual, criminal complaints − presented to public opinion and to the competent authority from 2010 to this day have not been answered despite being perfectly supported with documents.
Altrettanto significativo è il fatto che su questa frode internazionale da un miliardo e mezzo di euro a danno di Trieste vi sia, a parte la Voce, un silenzio stampa totale dei media locali e nazionali italiani, incluse testate d’inchiesta celebri come “Il Fatto quotidiano” e “Report”. E questo silenzio stampa italiano si riflette sui corrispondenti esteri e sui media internazionali.
It is as much meaningful that, when it comes to this international fraud amounting to EUR 1,5 billions, committed at a disadvantage of Trieste, except La Voce di Trieste, other newspaper and media, both local and national, including famous investigative media like newspaper “Il Fatto quotidiano” and TV broadcast “Report”, remain silent. And this blackout of Italian press affects both corresponding journalists and international media.
La strategìa di Trieste Libera contro il sistema di corruzione
The strategy of Free Trieste against the system of corruption
Oltre a fornire tutte le informazioni giuridiche necessarie, il documento che il presidente del Movimento Trieste Libera, Roberto Giurastante, ha inviato al Presidente italiano dimissionario, alle diplomazie dei Paesi interessati, all’Autorità Anticorruzione italiana ed al Ministro italiano per le Infrastrutture ed i Trasporti, Maurizio Lupi, denuncia questo retroscena di corruzione con estrema chiarezza, indicando esattamente anche le ipotesi di reato corrispondenti secondo l’ordinamento italiano.
Besides providing all needed, legal information on this matter, the President of the Free Trieste Movement, Roberto Giurastante, did also send to the outgoing President of the Republic of Italy, to the diplomatic offices of the concerned States, to Italian anti-corruption authorities and to the Italian Minister of Infrastructure and Transport Mr. Maurizio Lupi a document which describes this background of corruption very clearly, as well as precisely identifying − under Italian law − the alleged offences committed by this system.
Il documento precisa in particolare che «I rischi di riciclaggio connessi alla speculazione illecita su quelle aree sono palesi, e nelle operazioni per imporla sono già risultati coinvolti individui ed imprese sottoposti a provvedimenti anticorruzione ed antimafia o collegati ad ambienti indagati nell’ambito definito dalla legge n. 17/1982.» che è quella contro i poteri trasversali. Lo scandalo delle tre norme-truffa dovrebbe essere perciò oggetto anche di un’inchiesta parlamentare italiana sotto questo aspetto.
The document does especially remind that «The risks of money laundering related to the illegal speculation incumbent on these areas are clear and, as for the operations to impose that, it already results that individuals and companies undergoing anti-corruption and anti-mafia measures – or related to groups investigated under the terms of Law No. 17/1982 – are involved.» it is the law against transversal powers. Therefore, the scandal of the three fraud-norms should undergo an Italian parliamentary inquiry on that matter.
Dopo la promulgazione della legge, il Movimento Trieste Libera per difendere giuridicamente e politicamente il Porto Franco internazionale di Trieste adotterà una strategìa molto semplice, fondata su tre generi di strumenti principali. Ed ai primi due dovrebbero associarsi anche tutti i politici italiani onesti e correttamente informati.
Once the law is promulgated, in order to legally and politically defend the international Free Port of Trieste, the Free Trieste Movement shall enforce a very simple solution, grounded on three main instruments. And, as for the first two, even all the honest and well-informed Italian politicians should join.
Per prima cosa, i contenziosi che verranno aperti dalla legge finanziaria italiana con le tre norme-truffa sul Porto Franco internazionale di Trieste possono venire evitati, anche su iniziativa di altri Paesi interessati, con un decreto del Governo italiano che sospenda immediatamente l’applicazione di quelle tre norme perché sono anticostituzionali, seguito da una legge del Parlamento che le abroghi per lo stesso motivo.
First of all, the legal proceedings that are following the Italian financial law with three fraud-norms about the international Free Port of Trieste in it can be avoided, even following the demand of other, concerned States, with a decree with which the Italian Government does immediately suspend the enforcement of these three norms as they are against the Constitution, followed by a law with which the Parliament cancels these for the same reason.
In caso contrario l’illegittimità internazionale e costituzionale delle tre norme-truffa consentirà a Trieste Libera, ma anche agli imprenditori ed agli Stati interessati, di bloccarne ogni provvedimento attuativo all’interno dello stesso ordinamento italiano, per mezzo di semplici ricorsi che eccepiranno l’anticostituzionalità e la carenza di sovranità e giurisdizione dello Stato italiano sul Porto Franco del Free Territory of Trieste.
Otherwise, the international and constitutional illegality of the three fraud-norms shall allow Free Trieste, but also businessmen and States holding interests on that, to block all the measures to enforce that by rising simple appeals within the very Italian legal system, bringing forward the anti-constitutionality of the norms as well as the lack of both sovereignty and jurisdiction of the State of Italy over the international Free Port of the Free Territory of Trieste.
Il terzo strumento sono, ovviamente, i ricorsi internazionali e comunitari europei a difesa del Porto Franco internazionale del Free Territory of Trieste.
Obviously, the third instrument is appeals before international and European institutions to defend the international Free Port of the Free Territory of Trieste.
Le indagini antimafia ed anticorruzione
Anti-mafia and anti-corruption investigations
Nel frattempo gli osservatori si attendono risultati concreti anche dalle indagini anticorruzione ed antimafia riservate che sono già in corso in Italia sul “sistema” di corruzione che appoggia questa speculazione e truffa internazionale ingannando persino il Parlamento italiano.
At the same time, observers expect the anti-corruption and anti-mafia investigations − as Italian authorities are confidentially conducing these − on the “system” of corruption that supports this illegal speculation and international fraud to the point of deceiving the Italian Parliament.
È inoltre informazione pubblica che le coperture principali dell’operazione sono venute sinora dal partito di Governo, il PD di Matteo Renzi e della sua vicesegretaria Serracchiani, anche come presidente della Regione Friuli Venezia Giulia, assieme al sindaco PD di Trieste Cosolini, al deputato PD Ettore Rosato, al senatore Russo e ad altri esponenti locali di quel partito, in associazione trasversale con alcuni esponenti dell’opposizione di centrodestra come l’ex parlamentare e presidente regionale Antonione e l’ex sindaco Dipiazza.
It is also known to the public that, up to this moment, the main covers of the operation come from the ruling party, the Democratic Party – PD to which belong prime minister Renzi and his vice-secretary Ms. Serracchiani, who is also the President of Region Friuli Venezia Giulia, along with the mayor of Trieste Mr. Cosolini, Deputate Ettore Rosato, Senator Russo and other, local representatives who form a transversal consociation with come members to the center-right opposition, for example Mr. Antonione, former parliamentarian and president of the Region, and former mayor Dipiazza.
Questi politici dichiarano anche di rappresentare tutti i cittadini di Trieste, ma in realtà hanno utilizzato l’antidemocratico sistema elettorale italiano (che è illegale nel Free Territory of Trieste) per vincere le elezioni locali con il sostegno di appena il 20% dei cittadini che hanno diritto al voto.
These politicians do also claim to represent all the citizens of Trieste, but, as a matter of fact, they used the anti democratic Italian voting system (which is illegail in the Free Territory of Trieste) to win local elections depite receiving support by only 20% of the citizens who have the right to vote.
L’esistenza e le operazioni precedenti del “sistema Trieste” sono anche denunciate e documentate da anni nell’impressionante libro-inchiesta “Tracce di legalità”, di Roberto Giurastante, presidente dell’associazione ambientalista Greenaction Transnational e del Movimento Trieste Libera. Il libro è stato ristampato nel dicembre 2014 e ne è in preparazione una versione in inglese.
The existence, as well as the previous operations of “system Trieste” are also denounced, since years, in the amazing investigative book “Tracce di legalità” (Tracks of Legality) written by Roberto Giurastante, President of both environmentalist organization Greenaction Transnational and Free Trieste Movement. The book was reprinted in December, 2014, and an English version is being prepared.
La controprova della fondatezza delle sue indagini e denunce è data anche dalle pesanti operazioni di contrasto (incluse corruzioni giudiziarie) e dalle minacce, anche di tipo mafioso, cui il sistema di corruzione locale ha sottoposto e sottopone tuttora Giurastante per questo suo ruolo a Trieste, che è simile a quello di Saviano in Italia contro la camorra.
A further evidence of the truthfulness of his investigations and denounces is as well constituted by the aggressiveness of contrast operation (including judicial corruption) and to the − even mafia-like − threatens of the local system of corruption that Giurastante had to undergo and still undergoes due to his role in Trieste, a role which resembles that of Saviano, who stands against the camorra in Italy.
L’analisi di quelle stesse operazioni consente anche di tracciare la mappa della rete operativa attivata per compierle, che si estende dall’ambiente politico a quello istituzionale, giudiziario e mediatico, sino ai movimenti d’imitazione creati e sostenuti per ostacolare l’azione efficace di Trieste Libera.
The analysis of these very same operations does as well make it possible drawing the map of the operation net that commits these, which involves the world of politics, the institutions, justice, up to imitation movements established and supported in order to slow down the efficacious action of the Free Trieste Movement.

The Miller of Potsdam
L’espropriazione del Porto Franco di Trieste, organizzata con gli strumenti della corruzione per dirottare i traffici sui porti italiani controllati dalle mafie e per compensare i complici locali, assomiglia straordinariamente ad una celebre vicenda storica documentata dalla giurisprudenza tedesca del Settecento.
The expropriation of the international Free Port of Trieste, organized through the means of corruption in order to both divert trade traffics to the Italian ports under the control of mafias and to reward accomplices on the local level does sound very much like a famous, historical happening documented in German jurisprudence dating back to the XVIII Century.
È quella del mugnaio Arnold di Potsdam, che non poteva più pagare le tasse perché le acque del mulino, unica fonte di reddito della sua famiglia, venivano deviate da un barone avido e senza scrupoli. La giustizia locale corrotta aveva condannato Arnold consentendo al barone di rubargli anche il mulino, ed i giudici d’appello avevano confermato la sentenza.
It is the story of miller Arnold of Potsdam, who could no longer pay taxes because the waters of his mill, the only source of income for his family, had been diverted by a greedy, ruthless Baron. Corrupted local justice condemned Arnold and did even allow the Baron to steal the mill from him and, as he impugned the judgement, the judges in charge of the appeal confirmed that decision.
Ma il mugnaio e sua moglie Rosina reagirono portando la questione sino al tribunale di Berlino, dove altri magistrati corrotti gli diedero torto, sinché Federico il Grande, quale magistrato supremo, esaminò personalmente gli atti del processo, restituì alla coppia il mulino e condannò i giudici ingiusti al carcere ed a risarcirle i danni.
But the miller and with his wife, Rosina, reacted by bringing their instance up to the court of Berlin, where other, corrupted magistrates ruled against them, but as supreme magistrate, Friedrich the Great did personally examine the acts of the trial, restituted the mill to the couple and condamned the corrupted judges to conviction and to pay a reparation for the damages.
Questa è l’origine della celebre espressione di chi cerca giustizia: “ci sarà pure un giudice a Berlino”, che può essere anche il motto più appropriato per il caso internazionale di Trieste.
This is the origin of the famous saying pronounced by the ones longing for justice: “there must be a judge in Berlin”, which can also become the best motto for the international case of Trieste.
Perché il mulino di Trieste è il suo Porto Franco internazionale, e forse la giustizia finale sta nella possibilità che nei centri decisionali del mondo di oggi ci sia ancora un equivalente di Federico il Grande: se non a Berlino, a Vienna o a Bruxelles, certamente a Washington o a Mosca, oppure a Pechino.
Because as for Trieste, its mill is the international Free Port, and, maybe, the final justice lays in the possibility that in the decisional centers, in our present world, there is a man like Friedrich the Great: if not in Berlin, maybe in Vienna, in Brussels, most certainly in Washington or Moscow, or in Beijing.
